Terms of use
Last updated : November 4, 2026
These terms of use (the “Terms”) govern access to and use of the Vata service (the vata.eco website, the app.vata.eco web app and the mobile apps), published by Ochanta. By creating a card or using Vata, you accept these Terms.
1. Publisher
OCHANTA, SARL with a share capital of €2,000.00
21 rue Alfred Cortot, 34500 Béziers, France
SIREN: 892 564 121
Contact: contact form
2. Purpose
Vata is a digital business card service: each user has a card that can be opened through a link, a QR code or an NFC chip, which they can share, update and whose audience they can measure.
The Terms set out the rights and obligations of Ochanta and of users. They apply to anyone who creates a card, receives or views a card, or uses the app.
3. Acceptance and registration
Creating a card (tick box on the sign-up form) or using it means you fully accept the Terms. If you disagree, do not use the service.
You declare that you are at least 16 years old (or have your legal guardian's consent) and that you use Vata for professional purposes or for lawful personal use. You agree to provide accurate information and keep it up to date.
Vata does not use passwords: access to a card relies on an access key tied to your link or your sign-in QR code. Keep it confidential; any action made with it is deemed to be yours. If it is lost or stolen, contact us so we can replace it.
4. Description of the service
Depending on your plan, Vata lets you: create and customise your card (contact details, photo, logo, theme, language); share it by link, QR code or NFC chip; receive the contact details of people who scanned your card; follow other users' cards and be notified of their changes; scan QR codes and keep a history on your device; view view statistics; earn points, levels and badges; receive notifications.
Features may change. Ochanta may add, modify or remove features for technical or legal reasons or to improve the service.
5. Plans, pricing and advertising
Vata offers a free card and additional plans (for example a card with an NFC chip, or cards for a company). Financial terms (price, quantities, delivery times, invoicing) are stated in the relevant quote or order and supplement these Terms.
The free card is provided without commitment and can be deleted at any time (see section 12).
Advertising. The free versions of Vata may, in the future, display advertising, including advertising targeted on the basis of your use or interests. Such personalisation will only be enabled with your consent where the law requires it, and you will be able to withdraw it at any time. We will notify you of these changes in advance, in particular by updating the privacy policy and these Terms. Paid plans may be offered without advertising.
6. Company accounts
A card may be attached to a company. The company administrator may then, according to their rights, manage their colleagues' cards, view their statistics, group or merge accounts and remove a card. By joining a company, you accept these administration rights.
The company is responsible for the people it allows to use Vata and for the information they publish in its name.
7. Rules of use
You agree not to: impersonate anyone or publish false or misleading information; publish unlawful, defamatory, hateful, violent or pornographic content, or content that infringes the rights of others; use Vata for abusive solicitation or spam, or send mass unsolicited invitations; collect cards or contact details by automated means; attempt to access data or accounts that are not yours, disrupt the service or bypass its protections.
The contact details you receive from other users are sent to you so that you can get in touch about their request. You agree to process them in accordance with data protection law (GDPR) and not to use them for other purposes without their consent.
8. Content and rights of use
You remain the owner of the rights in the content you publish (text, photo, logo). You grant Ochanta a non-exclusive, worldwide, royalty-free licence, for as long as you use the service, to host, display and transmit this content within Vata, including to people who scan your card.
You warrant that you hold the necessary rights in this content and you are responsible for it.
9. Personal data
Ochanta processes your data in accordance with the GDPR, as described in the privacy policy. It sets out the data collected, why, how long it is kept and your rights of access, rectification, restriction and erasure. If targeted advertising is introduced, the privacy policy will specify the data used, the partners involved and how to manage your consent.
10. Intellectual property
The service, its software, brand, logo, visuals and editorial content belong to Ochanta or its licensors. No right is granted to the user other than the personal, non-exclusive and non-transferable right to use the service in accordance with the Terms.
11. Availability and liability
Ochanta strives to keep the service available but does not guarantee the absence of interruptions, errors or data loss (maintenance, outage, force majeure, failure of a network or a provider). The service is provided “as is”. Reading an NFC chip depends on the phone and its settings.
Ochanta is not responsible for content published by users, or for how third parties use information on a card its holder has chosen to make public. To the extent permitted by law, Ochanta's liability is limited to direct and foreseeable damage and excludes indirect losses (loss of revenue, opportunities or customers). These limits do not apply in case of gross negligence or wilful misconduct, nor to rights that the law grants consumers mandatorily.
12. Suspension, termination and deletion
You may delete your card and your data at any time, from the Account deletion page or via the contact form.
Ochanta may suspend or delete a card, after notice where possible, in case of breach of the Terms, fraudulent use, unlawful content or at the request of an authority.
13. Changes to the Terms
Ochanta may change the Terms, in particular to reflect a change in the service or the law. The applicable version is the one published on this page, with its update date. For significant changes, users are informed (in the app or by e-mail). Continuing to use Vata after an update means you accept the new Terms.
14. Governing law and disputes
The Terms are governed by French law. In case of a dispute, an amicable solution will be sought first; you can write to us via the contact form. If you are a consumer, you may use a consumer mediator free of charge. Failing agreement, the competent French courts will have jurisdiction, subject to mandatory rules of jurisdiction.
